Kinetic Studio – Terms & Conditions

By accessing or using any of Kinetic Studio’s sites, services, or offerings (“we”, “us”, “our”), you agree to be legally bound by these Terms and Conditions. Please read them carefully, as they govern all Kinetic Studio products, memberships, classes, and events.

1. Acceptance of Terms

By using our Sites or Services, you confirm your acceptance of these Terms. If you do not agree, please refrain from using our Sites or Services.

Kinetic Studio reserves the right to update or modify these Terms at any time. Continued use after any changes signifies your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. General Disclaimers

Kinetic Studio does not provide medical or health advice. Participation in physical activities carries inherent risks. You acknowledge and accept full responsibility for your own physical condition and participation limits.
You agree to release and hold harmless Kinetic Studio, its directors, and staff from any claims, injuries, or damages arising from participation, except where caused by proven negligence.

3. Return & Refund Policy

Dance Class Bookings

  • All purchases are final, non-refundable, and non-transferable.

  • For COVID-related timetable disruptions, students have one week from purchase to request a credit or refund.

  • Refunds will not be provided for change of mind, teacher substitutions, expired passes, or promotions.

  • To reschedule, please contact Kinetic Studio at least 24 hours in advance. Website-only cancellations are not eligible for refunds.

 

4. Regular Classes

Class Minimums

  • Classes will not run if fewer than 3 students are enrolled 3 hours before class.

  • In such cases, Kinetic Studio will notify enrolled students by email and phone.

Cancellations and Rescheduling (by Students)

  • 12 hours’ notice is required to cancel or reschedule a class.

  • Cancellations made within 12 hours of class time are non-refundable and non-transferable.

  • Late cancellations or no-shows will forfeit the class credit.

Refunds and Transfers

  • All class purchases are non-refundable and non-transferable.

  • Credits cannot be shared or transferred between students.

Cancellations (by Kinetic Studio)

  • We may cancel classes due to low attendance, instructor illness, facility issues, or unforeseen circumstances.

  • Affected students will be offered an option to reschedule or receive a class credit at our discretion.

Arrival and Participation

  • Please arrive 5–10 minutes early to ensure readiness and safety.

  • Late arrivals may not be permitted to join once class has begun.

Safety and Conduct

  • Students are responsible for ensuring they are physically fit and medically cleared for participation.

  • Kinetic Studio is not liable for injuries, loss, or damage except where caused by negligence.

  • Respectful conduct towards instructors and fellow students is expected at all times.

Policy Updates

  • Kinetic Studio reserves the right to amend these policies at any time. Updates will be reflected on our website.

 

5. K-Pop Night Showcase 2025

Participation

  • Students may join up to 4 teams. Additional team participation requires prior approval.

Fees

  • Regular Team: 8 weeks – $280 + $49 registration

  • Soloist: 8 weeks – $320 + $49 registration

  • Backup Dancer: 8 weeks – $200 + $49 registration (fee optional, required for T-shirt)

Conditions

  • All payments are non-refundable and non-transferable.

  • Registration is required and charged once per student, regardless of the number of teams.

  • Soloist roles are ineligible for team discounts.

  • Students may miss one session maximum; further absences may result in removal.

Additional Training

  • Optional team-approved sessions may be arranged.

  • Missed sessions must be caught up individually or via private lessons ($35/session).

Under-18 Participants

  • Parental consent and a signed consent form are mandatory before payment.

 

6. Kinetic Showcases

  • All showcase purchases are final.

  • One Showcase Registration is mandatory to perform.

  • Students may miss only one rehearsal session.

  • Teams unable to form (minimum 4 members) may be eligible for refunds or transfers.

  • If rescheduled due to external factors, a class pass credit will be issued — no cash refunds.

 

7. Showcase Subscriptions

  • $35 per week for 8 weeks.

  • $49 registration fee must be paid upfront.

  • Non-payment for two weeks may result in removal without refund.

  • Subscriptions are final, non-refundable, and non-transferable.

 

8. Kinetic Courses

  • All course payments are final and non-refundable.

  • Missed sessions are not reimbursed.

  • Full payment is required upfront to secure your spot.

 

9. Memberships

Membership Options

  • Gold Membership – 15 classes over 4 months

  • Silver Membership – 10 classes over 3 months

  • Trial Membership – 5 classes over 2 months

Subscription Options

  • Weekly Subscription – 2 classes per week

  • Fortnightly Subscription – 4 classes every 2 weeks

  • Subscriptions renew automatically and can be cancelled at any time.

Terms

  • All memberships are non-refundable and non-transferable.

  • Unused class credits do not carry over.

  • Classes will not run with fewer than 3 students enrolled 3 hours prior; affected students will be notified.

  • Cancelled classes do not qualify for carry-over within subscriptions.

  • Kinetic Studio may, at its discretion, allow credit carry-over in special circumstances.

  • No refunds for relocations within 5km.

  • Pro-rated refunds only if Kinetic Studio ceases operations.

  • No refunds for expired memberships or unused sessions.

  • Purchase of any membership or subscription constitutes agreement to these Terms.

 

10. Products

  • Warranty claims are accepted within 2 weeks for eligible replacement or refund.

  • Returned products must be undamaged and in original condition.

 

11. Workshops & Events

  • All purchases are final.

  • COVID-related cancellations may qualify for class pass credit with valid proof.

  • No cash refunds for COVID-related disruptions.

 

12. Kinetic Projects

  • All payments are final, non-refundable, and non-transferable.

  • Missed sessions or withdrawals are not refundable.

  • Consent is required for footage use in promotional materials.

Filming & Completion

  • Projects must be completed within 3 months of the final session.

  • Delays caused by non-cooperation may lead to cancellation.

  • Absent members during filming must cover extra session costs.

 

13. COVID Policy

  • COVID absences must be supported by timestamped PCR or RAT results.

  • Compensation will be in the form of class passes only — no cash refunds.

  • Early project completion may qualify for refunds or passes at Kinetic’s discretion.

 

14. K-Pop In Public Projects

  • Editing decisions rest with Kinetic, the Teacher, and the Editor.

  • Participants must respect all final creative decisions.

  • Students under 16 require parental consent.

  • Attendance Policy - 2hr Sessions
    Due to the condensed schedule of 4 x 2-hour lessons, attendance at all sessions is mandatory. If you miss a class, you will be required to book a 2-hour private make-up lesson with a Kinetic teacher, charged at $100 per hour.

  • Final Lesson Policy
    If you miss the final session (Lesson 4), you will be required to cover the full cost of an additional 1.5-hour team practice, calculated at $40 per team member (e.g. $40 x number of participants).

  • Failure to do so will result in removal from the team, and your teacher will take your place in the performance.

  • Out of respect for your teammates and the Kinetic team, please provide at least 24 hours' notice if you need to reschedule any lesson. If your team requires more than the initial 4x sessions, additional lessons can be arranged with a majority vote from the team. Please note that the schedule may vary from the original plan please see above for rates.

  • Final Lesson Policy

  •  If you miss the final session (Lesson 4), you will be required to cover the full cost of an additional 1.5-hour team practice, calculated at $40 per team member (e.g. $40 x number of participants).

  •  Medical Absences/Emergencies

  • For any emergencies/sickness we need to be a bit more lenient on our policy. To better manage sickness-related absences, here are the following rules for any of these situations

  • 1. If you are sick, you must notify us no later than 11am on the day of your practice. This allows Kinetic the opportunity to attempt rescheduling with the team.

  • 2. First absence: no documentation is required.

  • 3. Second absence: a valid medical certificate must be provided, otherwise the absence will not be accepted.

  • 4. Ongoing absences: Kinetic may be required to remove you from sections of the dance, or in some cases, from the team.

Late Sessions

  • Underage participants require parental approval for rehearsals ending after 6 PM.

Rescheduling

  • Notify Kinetic at least 24 hours in advance.

  • Approval is subject to discretion; no refunds for late changes.

 

15. Studio Booking Policy

  • Cancellations after confirmation incur full payment.

  • Cancellations within 24 hours incur a 50% charge.

  • Cancellations within 12 hours incur a 100% charge.

 

16. Privacy

Use of our Sites or Services implies consent to our Privacy Policy.

 

17. Proprietary Rights

All content on our Sites is owned by Kinetic Studio or its licensors and protected under intellectual property law.
You may not reproduce, distribute, or modify any material without written permission.

 

18. Purchases & Pricing

By purchasing, you agree that:

  • You have read the full product or class description.

  • You enter into a binding purchase agreement.

  • Prices may change without notice. Kinetic Studio reserves the right to correct pricing errors.

 

19. Content License

By submitting or posting content, you grant Kinetic Studio a perpetual, royalty-free license to use, reproduce, and adapt your content for promotional purposes without compensation or attribution.
Removal requests will be considered at Kinetic’s discretion.

 

20. Limitation of Liability

Kinetic Studio does not guarantee uninterrupted or error-free service. Use is at your own risk.
We are not liable for:

  • Errors or omissions in content

  • Injuries or damages from participation

  • Security breaches or data loss

  • Service interruptions or external failures

  • User or third-party content

You agree to indemnify and hold Kinetic Studio harmless from any claims resulting from your use of our Sites or Services.

 

21. Zoom & Online Classes

By joining online sessions, you acknowledge responsibility for your own safety and environment.
Kinetic Studio is not liable for injuries sustained during remote participation.

 

22. Third-Party Links

Our Sites may contain links to third-party websites.
Kinetic Studio is not responsible for external content, accuracy, or policies.
All third-party interactions are at your own risk.

 

23. Final Acknowledgement

By using Kinetic Studio’s Sites or Services, you confirm that:

  • You are at least 18 years old (or have parental consent).

  • You have read and understood these Terms and any future amendments.

  • You understand that all purchases are final, unless stated otherwise.
